1. VALIDITY OF SALES CONDITIONS

1) Sales conditions are valid for purchasing goods on the probeebi.ee (Probeebi OÜ, registry code 14990667, legal address: Harju county, Tallinn, Tatari 18-15, 10116, phone: +372 56704094 and e-mail: info@probeebi.ee) website.

2) Besides these Conditions, the legal relations arising from the purchase of products from the probeebi.ee online store are also regulated by the Law of Obligations Act, the Consumer Protection Act and other legislation in force in the Republic of Estonia.

3) Online store probeebi.eereserves the right to change the sales conditions. These changes are reflected on the website www.probeebi.ee.

2. PRICE INFORMATION

1) The goods will be sent to the Purchaser using Ominva or Itella Smartpost parcel machines or to the Purchaser’s home by courier according to the price list of the service provider. Read more about delivery in section 6 and under the heading“Delivery”.

2) If the order has been submitted before a change being made to the sales conditions or prices, the conditions valid at the time of placing the order shall apply to the legal relations between the Purchaser and the online store probeebi.ee.

4) Online store probeebi.ee reserves the right to make changes in sales prices. These changes are reflected on the website www.probeebi.ee.

5) All prices are in euros.

3. PAYMENT METHODS

1) The probeebi.ee website allows to make payments using the bank links of Swedbank, SEB, Luminor, LHV, Coop Pank and PocoPay.

2) All payments are made in euros and deducted from the payer’s account in euros.

3) Bank link payments are mediated by Maksekeskus AS on the basis of a contract.

4) The online store is a controller of personal data. The online store forwards the personal data necessary for making payments to the authorised processor of database, Maksekeskus AS.

4. PLACING AN ORDER

1) Add the desired products to the shopping cart.

2) To place an order, click on the link “Start paying” in the shopping cart.

3) The ordering page requires you to fill the necessary data fields correctly, because the accuracy and correctness of the information provided is what the fast and smooth delivery of the goods and the subsequent possible settlement of disputes and claims depends on. Registering a client account, information about it will be sent to the e-mail address indicated in the data.

3) Indicate that you have read and agreed to the Sales Conditions and place an order by clicking on the button designated in such a way.

4) You will be able to see an invoice to be paid. The invoice is viewable at any time by logging in to your client account. The invoice will also be sent to the e-mail address indicated in the Client’s data.

5) Orders placed in the online store are processed on working days (Mon – Fri, 10:00 – 18:00). If the order is submitted on a Friday after 15:00, the order will take effect on the following Monday.

5. ENTRY INTO FORCE OF THE CONTRACT OF SALE

1) Online store probeebi.eeundertakes to transfer the existing Goods or the Goods to be acquired and to enable the transfer of ownership of the Goods to the Purchaser, the Purchaser undertakes to pay to online store probeebi.ee the sum indicated on the invoice for the Goods and to accept the Goods.

2) The contract of sale enters into force after the payment made by the Purchased has been received on the bank account of the probeebi.ee online store.

6. DELIVERY

1) ) After the contract of sale enters into force, the probeebi.ee online store guarantees the delivery of the Purchaser’s order and its transfer to the company’s logistics partners for delivery. 

2) The delivery terms indicated on the website of the online store are valid from the moment the amount to be paid for the order has been received on the bank account of the probeebi.ee online store.

3) To be able to make a delivery without delay, care must be taken, true and valid data must be provided when entering the delivery data while placing an order.

4) Online store probeebi.ee is not liable for the delay in the delivery of the goods if the goods have been provided to the logistics partners on time, but the delay in delivery is due to circumstances that probeebi.eeonline store could not have influenced or foreseen.

5) Delivery methods- The goods will be sent all over Estonia, to the Omniva or Itella Smartpost parcel machine closest to you.

7. RIGHT OF RETURN

1) After receiving the order, the Purchaser has the right to withdraw from the contract concluded with the online store within 14 days. If the goods are defective or the wrong product has been sent, the withdrawal costs will be paid by the probeebi.ee online store, in other cases the withdrawal costs will be paid by the Purchaser.

2) Upon receipt of the goods, make sure that the packaging of the goods is intact. Before signing the consignment document, please make sure that the packaging of the goods is intact. Claims submitted later will not be satisfied. The returned goods must be unused, complete and in their original packaging, the packaging must not be broken or damaged. To ascertain the nature, characteristics and functioning of the item, the Purchaser must handle and use the goods only as he would normally be allowed in a shop.

3) To return the goods, a purchase withdrawal application must be submitted, this can be submitted in a free form and sent to the e-mail address info@probeebi.ee. The withdrawal application must indicate the products to be returned, the reason for returning the products, person’s forename and surname and the order number.

4) The Purchaser must return the goods to the probeebi.ee online store no later than within 14 days from receipt of the goods.

5) Online store probeebi.ee shall return the amount paid for the goods to the Purchaser without delay, but not later than within 14 days.

6) The online store has the right to withdraw from the sales transaction and to reclaim the goods from the Purchaser if the price of the goods has been marked in the online store at a level significantly below the market price due to a mistake.

8. FORCE MAJEURE

1) Online store probeebi.ee shall not be liable for damages caused to the Purchaser or delay in the delivery of the goods if the damage or delay in the delivery of the goods is due to circumstances that the probeebi.eeonline store could not influence or foresee.

9. PROCEDURE FOR SUBMITTING CLAIMS

1) Goods sold by the probeebi.eeonline store, have a 2-year term for submitting claims as provided for in § 218 (2) of the Law of Obligations Act.

2) In the event of a defect becoming apparent, the Purchaser must submit a claim to theprobeebi.ee online store no later than within two months of becoming aware of the defect, attaching a digital or paper invoice on the basis of which the goods were paid for.

3) Online store probeebi.eeis not liable for the following:

– defects in the product due to the fault of the purchaser, resulting from non-compliance with the products instructions for use, improper or non-purposeful use and storage of the product;

– normal wear and tear of the product.

4) In the event of non-compliance or defects of the product, please send a claim to the e-mail address info@probeebi.ee, indicating the name of the person making the order, contact phone number, order number and a precise description of the product’s non-compliance or defect.

5) All claims will be reviewed, and the Purchaser shall be contacted as soon as possible, but no later than within 14 days from the receipt of the claim.

10. PURCHASER’S RIGHT TO TURN TO THE EUROPEAN UNION CONSUMER DISPUTE RESOLUTION PLATFORM

1) If the Purchaser has claims against the Online Store, these claims must be sent to the e-mail address info@probeebi.ee.

2) Upon the Purchaser and the Online Store being unable to resolve the dispute by agreement, the Purchaser can turn to the Consumer Disputes Committee. The procedural conditions can be viewed and the application be submitted HERE. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the Purchaser and the Online Store. The review of the Purchaser’s complaint by the Committee is free of charge.

3) The Purchaser may turn to the European Union Consumer Dispute Resolution Platform.
